fa تحول رژیم حقوقی بین‌المللی حفاظت از محیط زیست دریایی در مقابل آلاینده‌های مستقر در خشکی؛ از مونتگوبی تا کارتاگنا پژوهشي Research/ Original/ Regular Article <div align="justify" style="direction: rtl"> منابع آلودگی دریاها گسترده و متنوع است، تا بدانجا که علاوه بر آلودگی‌های نفتی، آلودگی‌های جوی، تردد کشتی‌ها و فعالیت‌های اکتشافی در بستر دریاها، منابع آلاینده‌ی دیگری وجود دارند که گرچه منشأ آنها در خشکی است، لیکن از مهم‌ترین منابع آلاینده‌ی دریاها محسوب می‌شوند؛ که از جمله می‌توان به مواردی همچون تخلیه‌ی پسماندها و دفع زباله‌های شهری در دریا، ایجاد جزایر مصنوعی، ورود پساب شور دستگاه‌های آب شیرین‌کن و غیره اشاره کرد. به رغم توجه ماده‌ی 207 کنوانسیون 1982 حقوق دریاها به آلاینده‌های مستقر در خشکی، و نظر به گستردگی و شدت فزاینده‌ی این آلاینده‌ها، مقابله با این معضل به دغدغه‌ای برای جامعه‌ی بین‌المللی بدل گشته است. در حقیقت، پیش بینی‌های کلی و عام کنوانسیون حقوق دریاها توان مقابله با تنوع و گستردگی پدید آمده را نداشت و مقررات حقوق بین‌الملل عام نیز به نظر نمی‌توانست به حد کافی کارایی داشته باشد. نظر به نقصان مطروحه، و با عنایت به اصرار اسناد جهانی و از جمله کنوانسیون فوق‌الذکر به گسترش همکاری-های منطقه‌ای، پس از تصویب کنوانسیون حقوق دریاها، در سطح منطقه‌ای با گسترش کنوانسیون‌های بسیاری روبرو بوده‌ایم که عموم آنها به مقابله با آلودگی‌های ناشی از منابع مستقر در خشکی نظری ویژه داشته‌اند و تحولی عمده را پیش روی حقوق بین‌الملل محیط زیست رقم زده‌اند. لذا، این مقاله در صدد بررسی سازوکارهای موجود در این زمینه، سنجش کارایی اسناد پدیدار گشته و شناسایی خلاء‌های احتمالی و جمع‌بندی و ارائه‌ی پیشنهاداتی حقوقی جهت صیانت هر چه بهتر از محیط زیست دریایی است. </div> There are broad and diverse sources for marine pollution. In addition to oil pollution, atmospheric pollution, ship traffic and exploration activities on the sea floor, there are other pollution sources. Although, originating from the land, they are among the most important sources of marine pollution. Waste discharge and disposal of such waste in the sea, creating artificial islands, entering brackish water from desalination devices and ... are examples of these sources. Despite the article 207 of the UNCLOS convention regarding the land-based pollution and due to an increasing extent and intensity of these emissions, dealing with this issue became a concern for the international community. In fact, general predictions of the UNCLOS were unable to cope with the diversity of the problem, and the rules of general international law were not effective enough. In view of the shortcomings discussed, and with regard to the insistence of international instruments, including the aforementioned Convention on the regional cooperation, we have faced a proliferation of instruments at the regional level, most of which have specifically dealt with the land-based pollution, so that the international environmental law of the seas has experienced a fundamental evolution.
