fa محورهای ارتباطی میان تحقیقات علمی دریایی و مقوله حفاظت از محیط زیست دریایی:یک واکاوی حقوقی بین‌المللی پژوهشي Research/ Original/ Regular Article تحقیقات علمی دریایی، به سلسله مطالعه‌ها و آزمایش‌هایی اطلاق می‌گردد که با هدف بالا بردن آگاهی انسان‌ها از محیط زیست دریا به انجام می‌رسند. بر اساس همین تعریف کلی می‌توان دریافت که دو مقوله‌ی تحقیقات علمی دریایی و حفاظت از محیط زیست دریایی دارای برهم‌کنش و تأثیر و تأثر بر ابعاد عملی و نظری یکدیگرند. از افق مؤلفه‌های حقوق بین‌المللی، بررسی و نظاره‌ی این بر‌هم‌کنش‌ها و سرانجام واکاوی و ارزیابی این دو مقوله در اسناد حقوقی بین‌المللی دریایی از جمله کنوانسیون 1982 ملل متحد حقوق دریاها از اهمیت به‌سزایی برخوردار است. آنچه ضرورت انجام این پژوهش را پر رنگ می‌کند آن است که از یک سو، انجام تحقیقات علمی در عرصه دریاها و اقیانوس‌ها باید در چارچوب یک سلسله مقررات و موازین بین‌المللی موجود در عرصه حقوق بین‌الملل، از جمله مقررات و موازین مربوط به حفاظت از محیط زیست صورت پذیرد که به‌ناچار حقوق و تعهداتی را برای تمامی دولت‌ها و سازمان‌های بین‌المللی در این زمینه در پی دارد، و از سوی دیگر، همین تحقیقات علمی دریایی، خود باید با هدف بالا بردن دانش بشر دایر بر حفاظت بهتر و مؤثرتر از محیط زیست، به‌ویژه محیط زیست دریایی به انجام رسند. Marine Scientific Research is a research process through which human beings obtain knowledge of the environment and find ways of how to protect and preserve thereof. Based on the said definition, this article argues that marine scientific research is closely interrelated with marine environmental protection. From the international law of the sea perspective, evaluation and analysis of the interrelation between the two concepts within the international legal instruments, namely and most importantly, 1982 United Nations Convention on the Law of the Sea possesses an outstanding significance.
