fa صورت‌بندی و تحلیل ابعاد پیوستگی سازمان بین‌المللی دریانوردی با کنوانسیون حقوق دریاها 1982 Formulation and analysis of the dimensions of the International Maritime Organization's affiliation with the 1982 Convention on the Law of the Sea حقوق دریا (بین الملل، خصوصی، عمومی) Law of the Sea مروری Review Article <div style="text-align: justify;">پیشینه و اهداف: پس از جنگ جهانی و ظهور سازمان‌های بین‌المللی در عرصه نظام بین‌الملل، جهان شاهد تغییر در چینش بازیگران بین‌المللی بود. یکی از این سازمان‌های بین‌المللی، سازمان بین‌المللی دریانوردی (ایمو) بود. این سازمان به عنوان آژانس تخصصی سازمان ملل متحد در زمینه تخصصی دریانوردی و مسایل مرتبط با آن فعالیت می‌کند. از سوی دیگر، کنوانسیون حقوق دریاها مصوب 1982 میلادی نیز مهم‌ترین سند در زمینه حقوق دریاها است که تا کنون تصویب شده است و نقش مرجع را ایفاء می‌کند. این پژوهش در پی واکاوی و تبیین سطح مناسبات ایمو و کنوانسیون حقوق دریاها است. <w:sdt contentlocked="t" docpart="F9DD27AB4AE444679D5FCD76E7DEAB87" id="-43291168"></w:sdt>روش ها : روش توصیفی- استقرایی به‌عنوان روش غالب این مقاله انتخاب شده است و از روش کتابخانه‌ای و ابزار فیش‌برداری برای گردآوری داده‌ها استفاده شده است. بنابراین برای این پژوهش به توصیف تاریخی دو نهاد ایمو و کنوانسیون حقوق دریاها و سپس به کارویژه‌های مشترک میان این دو نهاد و تعیین و تبیین سطح ارتباطاتشان در گستره حقوق بین‌الملل پرداخته می‌شود. <w:sdt contentlocked="t" docpart="E63CED18DA9D4234BAC3B2F351C0ACDB" id="-2054305338"></w:sdt> یافته ها:این کنوانسیون در مواد مختلف به سازمان بین‌المللی دارای صلاحیت اشاره دارد که منظور ایمو است. البته نام ایمو به صراحت فقط یک بار و در ضمیمه هشتم کنوانسیون ذکر شده است. همچنین نوع ارتباطات ایمو با کنوانسیون حقوق دریاها به دو دسته کارکردی و موضوعی تقسیم می‌شود. در بُعد کارکردی؛ کنوانسیون حقوق دریاها، ایمو را به عنوان یک سازمان دارای صلاحیت، تدوین‌کننده و منبع قوانین و استاندارد‌های بین‌المللی و در نهایت به‌عنوان حمایت‌کننده و تسهیل کننده اجرای قوانین و مقررات شناسایی کرده است. در بُعد موضوعی نیز زمینه‌های کاری مشترک این دو نهاد بین‌المللی در حوزه‌های ایمنی دریایی، امنیت دریایی، محیط زیست دریایی و مسئولیت مدنی ناشی از آلودگی دریایی تعریف شده است. <w:sdt contentlocked="t" docpart="50D7C618325C4EB99A9DEDB609ED4203" id="417220428"></w:sdt>نتیجه گیری: کنوانسیون حقوق دریاها دارای نقش چارچوبی است و به صورت کلی به مسائل مرتبط به دریا اشاره دارد و نقش قانون‌سازی در این مسایل را به ایمو به عنوان سازمان بین‌المللی دارای صلاحیت واگذار کرده است. در نتیجه ایمو با توجه به نقش‌های قابل ایفاء که در برخی مواد کنوانسیون حقوق دریاها به آن اشاره شده است و همچنین متناسب با زمینه‌های فعالیت مندرج در اساسنامه سازمان، ساختار تشکیلاتی و اسناد صادره خود را در حوزه‌های ایمنی دریایی، امنیت دریایی، محیط زیست دریایی و مسئولیت مدنی ناشی از آلودگی دریایی، تدوین و مصوب کرده است.  </div> <div style="text-align: justify;"> </div> <div style="text-align: justify;"> </div> <div style="text-align: justify;"> </div> <div style="text-align: justify;"><w:sdt contentlocked="t" docpart="9B50986272CF40FA9DF953669D3FCFCB" id="1334564118"></w:sdt>Background and Objectives:After the world war and the emergence of international organizations in the field of the international system, the world witnessed a change in the arrangement of international actors. One of these international organizations was the International Maritime Organization (IMO). It operates as a specialized agency of the United Nations in the field of maritime affairs and related matters. On the other hand, the Convention on the Law of the Sea, adopted in 1982, is the most important document in the field of the law of the sea that has been ratified so far and plays the role of a reference. This research seeks to analyze and explain the level of relations between emo and the Convention on the Law of the Sea.</div> <div style="text-align: justify;"><w:sdt contentlocked="t" docpart="7AAA415BD37E469787E77B076B4B77E9" id="86888520"></w:sdt>Methods:The descriptive-inductive method has been selected as the dominant method in this paper and the library method and filing tools have been used to collect data. Therefore, for this research, the historical description of the two institutions, the Imo and the Convention on the Law of the Sea, and then the common features between these two institutions and determining and explaining the level of their relations in the field of international law are discussed.</div> <div style="text-align: justify;"><w:sdt contentlocked="t" docpart="7652B801CC6045EA96B8A14B5145024B" id="-794132767"></w:sdt>Findings: This convention refers in various articles to the competent international organization, which means emo. Of course, Emo's name is only explicitly mentioned once in Annex VIII of the Convention. Also, the type of emo relations with the Convention on the Law of the Sea is divided into two categories: functional and thematic. In the functional dimension; The Convention on the Law of the Sea identifies Emo as a competent body, the drafter and source of international laws and standards, and ultimately the supporter and facilitator of the implementation of laws and regulations. In the thematic dimension, the fields of joint work of these two international organizations in the fields of maritime safety, maritime security, marine environment and civil liability due to marine pollution are defined.</div> <div style="text-align: justify;"><w:sdt contentlocked="t" docpart="F1E90F35F12543E880A1B6CC169C940B" id="-563871280"></w:sdt>Conclusion:The Convention on the Law of the Sea has a framework role and generally addresses maritime issues, leaving the role of legislator in these matters to IMO as the competent international organization. As a result, according to the plausible roles mentioned in some articles of the Convention on the Law of the Sea, as well as in accordance with the fields of activity contained in the Articles of Association, its organizational structure and documents issued in the fields of maritime safety, maritime security, marine environment.
