fa بررسی کنوانسیون وضعیت حقوقی دریای خزر: صلاحیت دولت‌های ساحلی در منطقه ماهیگیری Study of the convention on the legal status of the Caspian Sea: jurisdiction of coastal states in the fishery zone حقوق دریا (بین الملل، خصوصی، عمومی) Law of the Sea پژوهشي Research/ Original/ Regular Article <div style="text-align: justify;">پیشینه و مبانی نظری پژوهش: با انعقاد «کنوانسیون وضعیت حقوقی دریای خزر» موسوم به « کنوانسیون آکتائو» در سال 2018، منطقه ماهیگیری به عنوان یکی از مناطق چهارگانه این دریا به رسمیت شناخته شد. با عنایت به سکوت «کنوانسیون آکتائو» در رابطه با بسیاری از موضوع‌های صلاحیتی در این منطقه، هدف از مقاله حاضر تعیین صلاحیت دولت‌های ساحلی دریای خزر در پرتو مقررات حقوق بین‌الملل است. روش‌شناسی: موضوع حاضر، با روش توصیفی- تحلیلی و با عنایت به گردآوری اطلاعات به طور عمده کیفی تحقیق به روش کتابخانه‌ای و به صورت استفاده از اسناد، کتاب‌ها، مقاله‌های معتبر و تارنماهای مرتبط با موضوع مورد کندوکاو قرار گرفته است. یافته‌ها: بررسی متون حقوقی فارسی و نیز مطالعات تطبیقی بین‌المللی نشان می‌دهد که مقاله حاضر از جهت گستره موضوع‌های صلاحیتی و از جهت زمان مورد مطالعه در منطقه ماهیگیری، نسبت به مقالات پیش‌گفته دارای نوآوری بوده است. به عبارت دیگر، مطالعه این مقاله شامل صلاحیت‌های «تقنینی»، «قضایی» و «اجرایی» دولت‌های ساحلی در دریای خزر در دوران اخیر و پس از انعقاد کنوانسیون آکتائو می‌شود. نتیجه‌گیری: نتایج این جستار نشان می‌دهد که مطابق مقررات حقوق بین‌الملل دولت‌های ساحلی درخصوص طیف گسترده‌ای از موضوع‌ها از صلاحیت‌های تقنینی، قضایی و اجرایی در منطقه ماهیگیری برخوردار هستند و تسری مقررات مزبور توسط 5 دولت ساحلی به دریای خزر بهترین راهکار جهت حل و فصل چالش‌های صلاحیتی آتی هستند.</div> <div style="text-align: justify;">Background and Theoretical Foundations: Concluding the "Convention on the Legal Status of the Caspian Sea" which is known as "Aktau Convention" in 2018, the Fishery Zone was recognized as one of the four regions of the sea. Regarding to the Conventionchr('39')s silence on many of the jurisdiction issues in the region, the purpose of the paper is determining the jurisdiction of the Caspian Sea coastal states in the light of international law.   Methodology: the present topic was done by descriptive-analytical method and in regard to gathering the mainly qualitative information of research using library method by investigating withinthe books, authoritative papers  and related websites. Findings: Studing Persian legal texts as well as international comparative studies shows that the present article has been innovative compared to the aforementioned articles in terms of the scope of jurisdiction and the time studied in the fishing area. In other words, the study of this article includes the "legislative", "judicial" and "executive" jurisdiction of the coastal states in the Caspian Sea in recent times and after the concluding the Aktau Convention.
