fa اعمال صلاحیت در حقوق بین الملل دریاها در تقابل میان اصل آزادی دریانوردی و حق حفاظت از تاسیسات فراساحلی <div style="text-align: justify;">هدف از این مقاله بررسی اعمال صلاحیت در حقوق بین&shy;الملل دریاها و تقابل میان حق حفاظت از تاسیسات فراساحلی و اصل آزادی دریانوردی است. کشتی&shy;ها در دریاهای آزاد و مناطق فراساحلی تحت تابعیت دولت صاحب پرچم هستند. توقیف کشتی و بازداشت خدمه آن در منطقه&shy; انحصاری اقتصادی تحت حاکمیت دولت ساحلی به بهانه&shy; ی تجاوز به تاسیسات و تجهیزات فراساحلی وی دخالت در امور دولت صاحب پرچم و اعمال حاکمیت وی تلقی می&shy; شود. دولت ساحلی مجاز به اتخاذ تدابیر امنیتی برای پیشگیری و مدیریت مانورهای خطرناک فعالان زیست محیطی به تاسیسات دور از ساحل در اعتراض به فعالیت&shy; های دریایی وی است. نتیجه نهایی حاکی از این است که حسب نظریه&shy;ی اخیر قضات دیوان داوری توقیف کشتی و بازداشت فعالان زیست محیطی از سوی دولت ساحلی روسیه اقدامی غیرقانونی و در تعارض با صلاحیت دولت صاحب پرچم هلند است.</div> <div style="text-align: justify;">The goal of this article was to examine the Jurisdiction in International Law of the Sea in conflict&nbsp;between right to protection of offshore facilities and freedom of navigation. Ships are under nationality of&nbsp;their flag state in the high seas and offshore zones. Seizure of the ship and arrestment of its crew in the&nbsp;exclusive economic zone under the control of the coastal government on the pretext of violating its&nbsp;offshore facilities and equipment were assessed interference in flag State and his sovereignty affairs.&nbsp;Coastal government is allowed to take security measures to prevent and manage dangerous maneuvers of&nbsp;environmental activists to offshore facilities in protest to its offshore activities. Final conclusion showed&nbsp;that seizure of ships and arrest of environmental activists by the Russian state is an illegal act and in&nbsp;conflict of jurisdiction of the Netherland&rsquo;s flag State according to the recent judgment of the Arbitration<br> Tribunal.</div> دیوان بین المللی حقوق دریاها, دولت ساحلی, دولت صاحب پرچم, منطقه ی انحصاری اقتصادی, فلات قاره, تاسیسات دور از ساحل.
