fa نظریه ی مشورتی دیوان بین المللی حقوق دریاها؛ تجلی تعهدات دولت صاحب پرچم راجع به صید غیرمجاز کشتی حامل پرچم وی در منطقه انحصاری اقتصادی دولت ثالث پژوهشي Research/ Original/ Regular Article <p style="text-align: justify;">منطقه انحصاری اقتصادی در عین حال که تحت صلاحیت قضایی دولت ساحلی است، لیکن با شرایط خاص مقرر در کنوانسیون حقوق دریاها از حقوق و آزادی &nbsp;های دیگر دولت ها برای بهره برداری از منابع زنده آن برخوردار است. کشتی های ماهیگیری تحت صلاحیت دولت صاحب پرچم در مناطق انحصاری اقتصادی دولت های ثالث به صید منابع زنده دریایی می پردازند. در حالی که دولت صاحب پرچم متعهد به جلوگیری از فعالیت غیرمجاز کشتی های حامل پرچم خود است. دولت های ساحلی نیز برای تعیین چارچوب تعهدات دولت های صاحب پرچم متکی به سازوکارهای دیوان بین المللی حقوق دریاها هستند. یکی از این سازوکارها تقاضای صدور نظریه ی مشورتی از دیوان بین المللی حقوق دریاها است. کمیسیون شیلات دولت های ساحلی آفریقا، در نشست اضطراری وزرای دولت های عضو خود طی قطعنامه ای از دیوان بین المللی حقوق دریاها صدور نظریه ی مشورتی را تقاضا کرده است. این نظریه مشورتی در رابطه با تعهدات دولت صاحب پرچم راجع به صید غیرمجاز کشتی حامل پرچم وی در منطقه ی انحصاری اقتصادی دولت های ساحلی عضو در این کمیسیون است. دیوان بین المللی حقوق دریاها نیز در تاریخ 2 مارس 2015 نظریه مشورتی خود را راجع به تعهدات دولت صاحب پرچم نسبت به صید غیرمجاز کشتی حامل پرچم خود در منطقه انحصاری اقتصادی دولت های عضو صادر کرده است. این نظریه مشورتی مبتنی بر مقررات کنوانسیون حقوق دریاها و کنوانسیون تعیین شرایط حداقلی و متأثر از دست آوردهای نظریه مشورتی شعبه حل اختلاف بستر دریاها و رویه دیوان بین المللی دادگستری است که موضوع این نوشتار قرار گرفته است.</p> <p style="text-align: justify;"><a name="OLE_LINK95"></a><a name="OLE_LINK94">Exclusive Economic Zones are under the jurisdiction of the coastal states, but with certain conditions set forth in the Convention of the Law of the Sea, have rights and freedoms of exploiting their living resources. Fishing Vessels under the jurisdiction of the Flag State are to catch marine living resources in the Exclusive Economic Zone of third country. Meanwhile, the Flag State is obligated to prevent illegal fishing activities of the vessels flying their flag. Coastal states also rely on the mechanisms of International Tribunal for the Law of the Sea for determining the obligations of Flag States. One of these mechanisms is requesting for an Advisory Opinion from the International Tribunal for the Law of the Sea<span dir="RTL">.&nbsp;</span></a>African Coastal States Fisheries Commission in an emergency meeting of ministers of its member states issued a resolution and requested International Tribunal for the Law of the Sea for an Advisory Opinion about the obligations of the flag State in cases where illegal fishing activities are conducted by vessels flying their flag within the Exclusive Economic Zone of the coastal states that are members of the commission. International Tribunal for the Law of the Sea has issued its Advisory Opinion on 2 March 2015 that was about the obligations of flag state towards illegal fishing by vessels flying the flag of the member states in the exclusive economic zone based on provisions of the Convention of the law of the Sea and Convention on the Determination of the Minimal Conditions for Access and Exploitation of Mineral Resources Within the Maritime Areas under the Jurisdiction of the Member States.
